Order Acceptance Policy

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. 4home.us reserves the right at any time after receipt of your order to accept or decline your order for any reason. 4home.us reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed over $2000.00 (U.S.) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order. 4home.us is a reseller to end user customers and does not accept orders from computer dealers, exporters, wholesalers, or other customers who intend to resell the products offered by 4home.us.

Sales Taxes

4home.us shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within New York state. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state.

Price

The sale price of all merchandise is F.O.B. point of shipping. The 4home.us has the absolute right to modify at any time, without notice, any price initially submitted.

Delivery

Any delivery date may be given by the 4home.us from time to time will be an approximate date and may depend on factors that are out of control of the 4home.us.

Vendor

The VENDOR (4 Home Co.) reserves the right to make partial shipments and back-order items if the same are not in stock, without liability or responsibility of any kind for any added transportation costs or any other loss of damage incurred by reason of such back-orders.

Shipping Instructions

The 4home.us shall ship the merchandise using the carrier of his choice unless he is advised otherwise.

Damage Claims

The 4home.us accepts no liability or responsibility for damages in transit. All claims must be filed with the carrier within three (3) days following delivery.

Shortage Claims

All merchandise must be checked upon arrival. No shortage claim will be accepted by the 4home.us unless it was made in writing within three (3) days of receipt of the merchandise.

Return Of Merchandise

No merchandise may be returned for credit or exchange without the written acceptance of 4home.us. Only goods in their original unopened containers and in condition of resale can be accepted for credit within 15 days of their purchase. A minimum handling charge of 15% of the net value of the returned merchandise shall apply. The transportation costs shall be the PURCHASER'S responsibility.

Liability of the 4home.us

The 4home.us shall not under any circumstances be held responsible for any damages whatsoever arising from the improper, incorrect installation or manufacturing defect of the merchandise sold. In every other case, 4home.us's responsibility is limited to the price of the merchandise sold.

Made To Order Goods

Goods ordered according to the Purchaser's own specifications are not returnable nor subject to cancellation for any reason nor at any time whatsoever.

Collection Fees

It is specifically foreseen that the PURCHASER will be responsible for all legal costs to the collection of accounts of the 4home.us that remains unpaid. It is established that the amount to be paid will be equal to Twenty percent (20%) of the amount owed to the 4home.us.

Waiver

No waiver of any of the provisions of this agreement by the 4home.us shall be deemed to constitute a waiver of the 4home.us's rights according to the provisions of this agreement.

Assignment

The rights of the PURCHASER as established in this application are not assignable or transferable without the prior written authorization of the 4home.us.

Interpretation

The rights and obligations from this agreement will be interpreted according to the laws where 4home.us's place of business is situated.

Merchandise return policies

No merchandise may be returned for credit or exchange without the written authorization of 4 Home Co. and/or its subsidiaries. Only goods in their original unopened cartons and in resalable condition can be accepted for credit within 15 days of their purchase. A minimum handling charge of 15% of the net value of the returned merchandise shall apply. No credit will be allowed for discontinued merchandise. All merchandise must be returned at customer expense. All Merchandise must be verified by the customer upon delivery. Only previously authorized goods will be accepted for credit. We reserve the right to refuse unauthorized returns and have them returned at customer charge.

Special Merchandise

In any time and for any reason, special merchandise ordered according to buyer specifications will not be eligible for return or cancellation.

Claim For Damages

In case of damage during transportation, 4 Home Co. and/or its subsidiaries, will not accept any obligation or responsibility. All claims for damages must be submitted to the transportation company.

Claim For Missing Merchandise

Any claim for missing merchandise will not be accepted by 4 Home Co. and/or its subsidiaries, unless it has been submitted in writing and report to our sales offices within three (3) days following receipt date of goods.

Unauthorized Modifications or Alterations Made To Product

Unauthorized modifications or alterations made to product, will cancel the product guarantee. Product then becomes none returnable for credit or exchange.

Procedures For Authorized Return

Contact our internal sales offices or your sales representative. An authorization for return will be given or mailed to you as soon as possible. Clearly identify the return with: the pre-authorized merchandise return number, your customer number, your order number, first and last name, and e-mail address. A credit will be issued within five(5) business days, following reception and verification of goods.

Service and Support

All requests for technical service and support should be made directly to the manufacturer in accordance with their terms and conditions.

Jurisdiction and Venue

You agree that any legal action brought against 4home.us shall be governed by the laws of the State of New York without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the 4home.us sites shall be an appropriate federal or state court located in Kings County New York.
